After a hearing before a local justice of the peace, defendant, George M. Bentley, was convicted of violating section 1016 (b) of The Vehicle Code of April 29, 1959, P. L. 58. An appeal was allowed by this court and, thereafter, a motion to quash the information upon which the said conviction is based was filed on behalf of the defendant.
