Charles E. Berling, defendant, has appealed from a judgment of the district court, on a jury verdict finding him guilty of aiding, abetting and counselling in the making and using of false documents, in violation of 18 U.S.C.A. §§ 1001 and 10021 as charged in count II of an indictment.

The jury also found Berling guilty on count I, which charged a conspiracy to make false statements in violation...
