WHITTLE, Justice.

This case is before us upon a writ of error to a final judgment of the Circuit Court of Rockingham County, entered on the 5th day of April, 1962.

Lohr filed suit against Ward Franklin Smith and Fred K. Betts, III, for personal injuries resulting from a collision between an automobile owned and operated by Lohr and a truck owned by Betts and operated by his employee, Smith.
