Newton, a Negro, was indicted, tried and convicted in a Louisiana criminal court on a charge of rape. On June 23, 1960, he was sentenced to death. Following the overruling of his motion for a new trial and his motion in arrest of judgment, Newton perfected an appeal to the Louisiana Supreme Court.
