The order to show cause, with affidavit of Clarence annexed, was filed in the county court of Jefferson county on June 18, 1962, and heard before Honorable CHARLES E. KADING on July 26, 1962, and September 5, 1962.

The pertinent language of the order to show cause reads that:

"It is hereby ordered that the plaintiff, Gladys Yelk, show cause . . . why an order should not be entered authorizing the defendant to deposit the sum of $2,250...
