This action was instituted in the Common Pleas Court of Jackson County by J. Hobart Davis, as plaintiff, to recover for personal injuries sustained by him in an automobile collision. The collision occurred on December 7, 1959, on State Route 124 in Jackson County, between an automobile owned and operated by the defendant, Elias J.
