The Rex Finance Company, a commercial partnership doing business in the City of New Orleans, caused the issuance herein of executory process to enforce the payment of a collateral promissory note made and subscribed by the defendants, Walter B. Cary and his wife, which was secured by a mortgage on their home located in the Parish of Jefferson.
