This matter is before this Court on an appeal by defendant wherein he states he is aggrieved by a judgment of the district court wherein the district judge did not consider his reconventional demand. Appellee filed an answer to the appeal. The appeal was filed on June 17, 1963, and the answer to the appeal and the motion to dismiss were filed on July 1, 1963.

In his answer to the appeal, plaintiff-appellee asserts that the appeal should be dismissed...
