Defendant (appellant) Ben E. Ellis was charged, tried and convicted on three counts of an information. Under the first count he was charged with selling mortgaged property in violation of G.S. 1961 Supp., 58-318. Count 2 charged him with obtaining money under false pretenses in violation of G.S. 1949, 21-551. Count 3 charged embezzlement in violation of G.S. 1949, 21-545. The jury found the defendant guilty...
