On 8 December 1947 plaintiff instituted an action in the Superior Court of Wake County against defendants Goodwin, Denson (appellee) and Hubert E. Gaster to recover damages for personal injuries suffered by him in a collision of automobiles. At the time of the collision plaintiff was a passenger in a car driven by Hubert E. Gaster.
