This suit in tort was brought by David J. Smith for personal injuries sustained by his seventeen year old son, on August 27, 1961, when the latter fell from a truck loaded with hay and received severe permanent head injuries. Named as defendants are John P. Whittington, the owner of the truck, Marquette Casualty Company, the liability insurer of the truck, and Hanover Insurance Company, who had issued in favor of Whittington a general liability policy...
