Appellant was charged with second degree murder and two counts of assault with a deadly weapon arising out of the homicide of Carlos Ravago and the wounding of his two brothers Hector and Ramon. After trial, a verdict of guilty of voluntary manslaughter in the death of Carlos and verdicts of not guilty on the two counts of assault were returned by the jury.
