The issue here is whether the Tax Commissioner of Whitfield County is entitled to a commission of 10% of the taxes collected in excess of 90% of the total taxes due according to the net tax digest of that county for the year 1961.

This question arose from the issuance of an execution by LeRoy Kaylor, Commissioner of Roads and Revenue of Whitfield County, against P. D. Clark, Whitfield County Tax Commissioner, for the amount of such commission...
