The plaintiff, Marlin L. Swinger, was a guest in a station wagon driven by Louis Don Taylor when the station wagon was involved in a collision with an automobile driven by Lee Roy Bell. Swinger instituted this action against both Bell and Taylor to recover damages for personal injuries sustained in the collision.
