Defendant Oak Construction Company, a prime contractor of defendant city of Harper Woods, subcontracted part of its construction project to plaintiff Anthony Salvatore. Upon completion of the subcontract, Salvatore sued defendants in assumpsit for the balance due him on his subcontract with Oak. Oak, in turn, filed a claim in recoupment against plaintiff.
