Donald Gisevius, aged 36, appealed from the judgment dismissing his suit against his former employer, Jackson Brewing Company, and its workmen's compensation insurance carrier, Employers' Liability Assurance Co., Ltd., for workmen's compensation as for permanent and total disability at the maximum rate for 400 weeks; plaintiff alleged that he had met with an accident during the scope and course of his employment as pipe fitter "on or about May 1, 1961...
