This action of assumpsit was instituted by plaintiff by writ of foreign attachment directing the sheriff of Bucks County to attach "all pension and retirement benefits now or hereafter falling due or payable to Joseph Pistone." Defendant, a resident of the State of New Jersey, is an employe of the Rohm & Haas Company of this county, upon which the attachment was served as garnishee.
