The petitioner, Hassie Cane Martin, is presently confined in the Kentucky State Penitentiary at Eddyville, Kentucky, under a judgment of the Fayette Circuit Court entered in October, 1960. At the April, 1960 session of the grand jury of that court an indictment was returned charging Martin and Willie Gaines Smith with the willful murder of Olin Alexander.
