PER CURIAM.

Defendant was indicted for the crime of selling beer to a minor, in violation of section 124.20, Code, 1962, I.C.A. He pleaded not guilty, was tried to a jury, found guilty and sentenced to pay a fine of $400 and costs. On default of payment of the fine and costs defendant was to be confined to the county jail for a period of one day for each $10 of the fine, not exceeding 40 days, all pursuant to Code section 124.37, I.C.A.
