Appeal is from judgment entered on an order dismissing an action for divorce under section 437c, Code of Civil Procedure.

Affidavits filed on the motion for summary judgment disclose the following. The parties were married in 1945, and separated in 1953; on August 4, 1953, appellant wife sued for divorce (No. D455586), and on August 13, 1953, obtained a pendente lite order requiring respondent to pay child support and alimony.
