On May 12, 1960, at approximately 5:00 p.m. the plaintiff, Keith E. Swigert, was proceeding in a northerly direction along Highway 51 approximately two miles north of Decatur, Illinois. He was driving a 1960 Pontiac convertible which he had owned approximately three weeks. He was accompanied by one William Harris.
