This action was originally commenced in August of 1955 by appellant, Ann Ruth Wisniski, against Roland Ong doing business as Roland's Market, Luis Meza, his employee, and others for false arrest and malicious prosecution. Following a trial and a verdict in favor of appellant, the trial court entered judgment notwithstanding the verdict in favor of appellees. On appeal, Wisniski v. Ong, 84 Ariz. 372,
