Plaintiff, Thomas Agatone, commenced an action in trespass in the Court of Common Pleas of Delaware County on March 15, 1961, claiming property damages and personal injuries by reason of an automobile accident.

The original complaint joined four defendants; that is, D'Antonio Construction Co., Inc., Joseph Marcasciano, Wayne G. Lyster & Sons, a partnership, and the Borough of Glenolden. Service was made upon all four defendants...
