Plaintiff filed a complaint against defendant on August 3, 1961. Answer was filed on August 15. Plaintiff then served and filed requests for admission of facts under the Utah Rules of Civil Procedure, on June 27, 1962, and on November 19, 1962. These requests were not answered, and on notice duly given, Motion for Summary Judgment came up for hearing on December 19. Plaintiff appeared, but defendant did not.
