This appeal is from a summary judgment entered in favor of the defendant, Selmer Gjesdal, for a dismissal of the plaintiff's action.

The action was instituted for the purpose of recovering damages for personal injury and property damage resulting from a rear end collision between a two-ton truck owned and operated by the plaintiff and a tractor owned and operated by the defendant.
