This action was instituted by plaintiff to recover treble damages and counsel fees for alleged overcharges in rent covering a period of two years commencing July 1, 1959 and ending June 30, 1961.

Prior to May 21, 1959 defendant was the owner of a 65-unit rent-controlled apartment dwelling located at 924 West End Avenue in New York City.
