Mr. Justice HARNSBERGER delivered the opinion of the court.

The district court consolidated for trial two separate actions. One of these originated in a justice court upon Davises' complaint against Hursts alleging unlawful detainer of property after nonpayment of rent. Restitution of the property to Davises was ordered, and a judgment against Davises of $200 was awarded Hursts on a counterclaim. No finding of the amount of rent due Davises was made and no judgment...
