The parties hereto intermarried in November, 1935. In June, 1943, while the parties were residing in New York, they entered into a property settlement agreement which settled their property rights and the custody and support of their two minor daughters. In August, 1943, the marriage was dissolved in this state by a decree of divorce wherein the property settlement agreement was approved but not merged in the decree.
