Wilmer Gleghorn owns 1600 acres of land surrounded by land of the W. T. Waggoner Estate. He has a recognized roadway from his house on the south portion of his 1600 acre tract across the Waggoner land to a public road on the south. He sued the Waggoner Estate to establish a right to a road from said public road across the Waggoner land to the north portion of his 1600 acre tract.
