This is an appeal from an order of the district court for Missoula County, Montana, denying a petition for a mandatory injunction and overruling the plaintiff's motion for a new trial.

In this cause, a rehearing was granted, and it appearing that the opinion heretofore promulgated on September 28, 1962, should be redrafted, the same was hereby withdrawn, new counsel allowed to reargue the case, and the following opinion substituted...
