This is a condemnation suit. A judgment was entered on the verdict of the jury and the condemning authority appeals.

The appellee testified that a short time before the date of taking, J. O. Porter, as agent, submitted to him a written offer to purchase the north 50 feet of his property, containing approximately 27,000 square feet, at a price of $.72 per square foot.
