This action was originally instituted by the plaintiff to recover the purchase price of certain pipe which the plaintiff sold to the defendant. The defendant thereafter filed a counterclaim alleging that a portion of the pipe was defective which resulted in damages in excess of the purchase price of the pipe. Jurisdiction is based on diversity of citizenship.
