OPINION BY MR. CHIEF JUSTICE BELL, January 22, 1963:

The appellants are counsel who were appointed by the Court of Oyer and Terminer of Philadelphia County to represent Johnson, an indigent defendant indicted for murder.

Johnson was indicted for murder in May, 1958. After presentation to that Court of his affidavit that he was destitute of means to employ counsel and prepare for his defense, the Judge sitting in the Court of Oyer and Terminer to whom the affidavit...
