On the morning of September 6, 1961, the defendants, Rufus Freeman and Jerry McGuire, were arrested by police officers near Filer, Idaho. On that same day a criminal complaint was made out, charging the defendants with the commission of a felony. The complaint, as amended on September 11, 1961, charged the defendants with the crime of robbery alleged to have been committed in Twin Falls County, Idaho, on the 5th day of September, 1961.
