This is an appeal by the State of New York from a judgment of the Court of Claims entered June 29, 1961 awarding claimant the sum of $88,250 less a partial payment of $12,000 for damages for the appropriation on July 29, 1958 in fee of certain parcels of real property located in the Village of Elmsford, Town of Greenburgh, County of Westchester.
