This action arises under the Workmen's Compensation Law. The decedent, Samuel M. Thresher, was killed in an accident on February 19, 1959, while employed by The Nurre Companies, Inc.

The deceased's fourteen year old daughter, Nancy, through her Guardian filed a claim for the death benefits. Appellant, Helen A. Thresher, also filed a claim to those benefits, alleging she is the common-law wife of decedent. The causes were consolidated...
