Irene Jones, individually and as guardian of the estate of Joel V. Jones, filed suit against the City of Abilene and Elmer Finch for damages. The city filed a cross action against a third party defendant, Norris, Hanley & Norris, hereinafter referred to as Norris, who had a paving contract with the city.
