The issue in this appeal is the right to custody of Rudolph, Jr., the son of these parties, born April 6, 1951. The plaintiff had been granted a divorce from defendant on March 23, 1959, on the ground of cruel and inhuman treatment, but under a stipulation approved by the court the defendant was to retain temporary custody of the child subject to certain rights of visitation in plaintiff until September 1, 1960.
