[1] The defendant was charged with; tried by a jury for; and convicted of an attempt to murder his wife. He moved for a new trial, which was denied. Thereupon judgment of imprisonment in the state prison was pronounced. From the judgment so entered and the order denying his motion for a new trial, he appeals.
