The plaintiff seeks damages against the defendant for injuries he sustained in an alleged unprovoked assault and battery committed upon him by the defendant. The incident took place in the City of New Orleans, on May 15, 1959. The plaintiff suffered an injury to his knee, necessitating surgery, for a torn anterior cruciate ligament, a torn medial collateral ligament, and removal of the medial meniscus.
