This litigation arose when D. S. Hudgens, Jr., filed a suit for equitable relief against L. H. Williams, Sr. In substance and so far as need be stated his original petition alleges: The defendant, Williams, owns a tract of land in Clayton County containing 49.23 acres, more or less. On November 2, 1960, he orally agreed to sell it to petitioner for $54,153 and petitioner agreed to buy it at that price if a title investigation to be made by him showed...
