The plaintiff was shot in the leg while deer hunting in Craftsbury during the 1958 open season on buck deer. This action, sounding in tort, was brought against the defendant, who admittedly fired at a deer at or about the same time that the plaintiff was wounded, and while hunting in the same wooded area. Trial in the Orleans County Court resulted in a jury verdict for the defendant, and from that verdict...
