DIMOND, Justice.

The basis for this action by Stephens against the Anchorage Independent School District is his complaint that real property owned by him was sold by the District unlawfully for "fictitious and illegal" taxes.

The property had been purchased by Don J. and Evelyn Perron on September 21, 1951, although their deed was not recorded until January 15, 1952. For the 1952-53 tax year the District imposed a tax of $16.65 based on an assessed valuation...
