These matters are before the Court on a motion to vacate the sentences imposed in both of the captioned cases.

Mover invokes the provisions of Rule 35, F.R.Civ.P., and Title 28 U.S.C. § 2255.

The grounds for the motions are "that the judgment and sentence was obtained without lawful process." In his motion mover alleges that he was arrested by a police officer of the City of New Orleans, Louisiana, on July 27, 1960...
