CHAVEZ, Justice.

Plaintiffs-appellants filed a first amended complaint on January 26, 1960, alleging that on or about February 5, 1956, appellee, Kitsch, breached an express or implied warranty made to appellants of a certain house as being fit for human habitation. It was also alleged that a dangerous amount of carbon monoxide accumulated within the house causing the plaintiff, Mela Chavez, to become violently sick.
