The auditor, to whom this action of tort was referred, found for the plaintiff. Thereafter, the case was tried to a jury who likewise found for the plaintiff. The case comes here on the defendant's exceptions to the denial of its motion for a directed verdict, to the denial of its motion to strike portions of the auditor's report, to certain rulings on evidence, and to the failure to grant a request for instruction.
