DIMOND, Justice.

In the district magistrate court the defendant, Gilley, was convicted of driving while intoxicated. On appeal to the superior court the judgment of conviction was affirmed. A further appeal has been taken to this court.

The defendant admits that the city's evidence, standing alone, was sufficient to convict him. But he contends that evidence he produced in defense was enough to create a reasonable doubt in the mind of the magistrate who tried...
