On April 8, 1961, appellee, Francis G. Miller, filed with the Estill County Court Clerk his declaration as a candidate for the Republican nomination for Mayor of Irvine, a fourth-class city, subject to the Republican primary election to be held on May 23, 1961. He had no opposition, so he became the nominee of his party without the placement of his name on the ballot.
