He thereafter unsuccessfully appealed his conviction to the highest court of that state (People v. Glinton, 8 N.Y.2d 742, 201 N.Y.S.2d 336, 167 N.E.2d 741 (1960)) remittitur amended (People v. Glinton, 8 N.Y.2d 849
