In May, 1961, McClary was convicted in the Criminal Court of Hamilton County as a professional gambler. Upon this conviction the District Attorney General filed the present proceeding to forfeit McClary's Thunderbird Ford automobile allegedly used in the furtherance of McClary's avocation as a professional gambler.
